Delta's rigged National Gallery bid reaches penalty clash

Delta Building Automation should face a $2.5 million fine for attempting to rig a bid for a National Gallery of Australia tender, according to the ACCC.

Lawyers for Delta Building Automation and the competition regulator came to blows in court on Friday over the extent Delta should pay for its attempt to rig a bid for a tender at the National Gallery of Australia.

The ACCC wants to see the company landed with a $2.5 million fine, but Delta is aiming to convince Federal Court of Australia Judge Robert Bromwich that a fine of between $300,000 to $400,000 will suffice.

Bromwich's decision, when it comes, will wrap up one of three civil-cartel lawsuits at varying stages before the courts at the time of writing.

It's almost five months since Bromwich found the company had attempted to engage in cartel conduct - an enduring enforcement priority for the ACCC - and two and a half years since the regulator announced the lawsuit.
