Technology company Swift Networks' $1.2 million penalty is the third civil-cartel win for the ACCC in 2023.

ASX-listed Swift subsidiary Swift Networks' admission of cartel conduct is the ACCC's third civil-penalty win this year.

In a brief Federal Court of Australia hearing today in Perth, lawyers for the competition regulator and Swift said they had agreed to propose penalties totalling $1.2 million for the technology company.

The fine might not look like much on paper compared with the potential maximum penalty of $60 million, but Federal Court of Australia Judge Craig Colvin was convinced it did the job.

The case involved conduct dating back to 2019. Swift entered into agreements with rival DXC to rig bids for tenders to provide technology services to mining camps in Western Australia.
