Legal battle erupts between Maxim and Australian publisher over 'rogue editions'
The US men's magazine faces an Australian court dispute with Nuclear Enterprises, claiming the local publisher’s national editions and online content are being published without a licence.
New York-headquartered Maxim Inc is attempting to prevent local publisher Nuclear Enterprises from issuing “rogue editions” of its magazine without a licence, the Federal Court of Australia has heard.
Lawyers for the US owners of the magazine, which says it caters to the “modern man”, told Federal Court Judge Helen Rofe on Friday that they are seeking an injunction to halt publication while the licensing dispute plays out over the next six to nine months.
From Nuclear Enterprises’ perspective, the application is untenable, barrister Shauna Ross told the online hearing today.
Ross said that if the injunction is granted, part of Nuclear Enterprises’ business “would be shut down”.
