Apple wins temporary pause on watch sales ban from US courts

More news: Apple has secured a temporary pause on the ban of sales of its smartwatches in the US. An appellate court has granted an interim stay for the device giant and the US International Trade Commission now has until January 10 to respond to Apple's push for a longer delay on the ban. Bloomberg reports that this decision appears to allow sales of the Apple Watch to resume.

Apple files appeal against US ban on smartwatches

The news: Tech giant Apple has appealed a decision to ban imports and sales of its watches in the US, based on a complaint from medical monitoring technology company Masimo.

The numbers: Apple has put sales of its Series 9 and Ultra 2 smartwatches in the US on hold since last week, though the watches remain available from some retailers including Amazon, Best Buy and Walmart. The smartwatch arm of the business generated approximately USD17 billion in revenue in 2023.

The context: Apple filed an emergency request for the US Court of Appeals for the Federal Circuit to halt the ban after the Biden administration declined to veto a government tribunal. It also asked the Federal Circuit to pause the ban, at least until the US Customs and Border Protection decides whether redesigned versions of its watches infringe Masimo's patents, and to put the ban on hold while the court considers Apple's request. Masimo has accused Apple of hiring away its employees, stealing its pulse oximetry technology and incorporating it into the popular Apple Watch. The US International Trade Commission's (ITC) order bars imports and sales of Apple Watches that use technology for reading blood-oxygen levels. US Trade Representative Katherine Tai decided not to reverse the ban following careful consultations, and the ITC's decision became final on 26 December.
