Deloitte's Optus cyber incident report will be part of class action case, court rules
The news: A Deloitte report into the cyber incident suffered by Optus in 2022 will be included in an ongoing class action, following a court decision today.
Federal Court of Australia Judge Jonathan Beach said Optus lawyers had "not made good" their claim for confidentiality, which in part relied on the assertion that the dominant purpose of the report had been for legal advice.
The numbers: Optus' mass data breach last year saw the potential exposure of almost 10 million individuals' personal data, including dates of birth, phone numbers, email addresses, driver's licences and passport numbers.
The context: Class action proceedings in the case were filed before the Federal Court in April. A separate investigation by the privacy regulator, the OAIC is ongoing.
