Domino’s ‘carefully reviewing’ class action judgment over delivery driver underpayment
The news: Pizza chain Domino’s said it is reviewing a Federal Court judgment made on Wednesday following a long-running class action case dating back to 2019.
The context: The class action was brought by Riley Gall, a former Queensland delivery driver who claimed Domino’s underpaid him over five years between 2013 and 2018.
The court found that Domino’s historical representations about the application of certain enterprise agreements during that time constituted misleading and deceptive conduct.
It assessed Gall’s loss to be in the order of $11,869, plus interest.
Domino’s said it is “carefully reviewing” the judgment, including any grounds of appeal that may be available.
The company said its potential wider exposure to other claims like Gall’s remains “highly uncertain and unquantifiable”.
Gall commenced the proceeding as a lead applicant on behalf of an alleged group of Australian franchisee employees who worked as delivery drivers or in-store workers.
“This depends on a separate hearing and determination in relation to the members of the group, the number of those members, each member’s individual claim of causation and the individual calculation of loss, and the exhaustion of all avenues of appeal available to Domino’s or other group members,” the company said.
