Employment Hero, Seek resolve legal proceedings

The news: Employment Hero and Seek have agreed to resolve a legal dispute that began in mid-June, with Employment Hero’s access to the Seek API to be reinstated.

The context: Employment Hero had initially sued Seek for a misuse of market power after it was denied access to Seek’s API. Seek later accused Employment Hero of improperly collecting job applicant information submitted to job listings posted on Seek through the Employment Hero platform.

A spokesperson for Employment Hero said the company “now accepts that Seek’s purpose in issuing the notice on 24 June 2025 terminating Employment Hero’s access to Seek’s API was not one of substantially lessening competition, as Employment Hero originally believed, and has agreed to resolve the proceedings”.

Employment Hero will regain access to the Seek API that enabled jobs to be listed on Seek via Employment Hero as long as it complies with applicable terms and conditions, according to a joint statement from the companies.

Seek had previously agreed to maintain temporary API access during the Federal Court proceedings, which the court has now ordered these proceedings be discontinued.

In the joint statement, the two companies said they would not comment further on the proceedings or the resolution.

What they said: “Seek is pleased that the litigation has now ended and is satisfied with the outcome,” a Seek spokesperson said.
