Former Super Retail chief legal officer loses suppression order appeal bid
The news: Former Super Retail Group chief legal officer Rebecca Farrell has lost an application to appeal a suppression order decision linked to her dismissal from the company.
The context: In December, Farrell lost an initial part of the case over her dismissal from the Super Cheap Auto operator, including arguments over the existence of a settlement agreement.
Details of any alleged settlement were suppressed as part of an initial and ongoing dispute between the company and Farrell.
Federal Court of Australia Michael Lee rejected the existence of an oral agreement between Farrell and her former employer in a December decision.
A broader case, including allegations of bullying and an affair between Super Retail chief executive Anthony Heraghty, who is named in the case, and his former head of human resources, is still to play out.
Farrell and national media companies Nine Entertainment and News Corp Australia had sought leave to appeal an earlier suppression decision.
But Federal Court Judge Yaseen Shariff dismissed the suppression order appeal today and said they should continue to apply until either orders made by Lee in December cease to operate or the continuation of the broader case before Lee.
