Santos ‘greenwashing’ lawsuit dismissed by Federal Court

The news: The Federal Court has found that gas giant Santos’ claims about decarbonisation were not misleading in a landmark ‘greenwashing’ lawsuit first brought by advocacy group the Australiasian Centre for Corporate Responsibility in 2021.

The context: Justice Brigitte Markovic’s reasons for the decision, which runs over about 250 pages, will be published on Monday to allow Santos time to consider any need for redactions.

The case considered allegations that Santos violated consumer and corporations law by engaging in misleading and deceptive conduct three claims related to decarbonisation.

This related to the company’s description that gas is a clean fuel and Santos is a clean fuel company, characterising blue hydrogen as zero emissions hydrogen during an investor day and claims about the feasibility of Santos’ net zero plan.

When the case was brought it was the first of its kind but similar cases have since been filed. In October 2025, a French court found that TotalEnergies violated consumer laws by making misleading claims regarding its environmental commitments.
