US appeals court temporarily reinstates Trump’s sweeping tariffs
The news: A US federal appeals court on Thursday local time (Friday AEST) temporarily reinstated President Donald Trump’s sweeping tariffs, after a trade court had ruled the president exceeded his authority under the International Emergency Economic Powers Act (IEEPA) and ordered an immediate halt.
The US Court of Appeals for the Federal Circuit issued a brief order pausing the lower court’s decision while considering the administration’s request for a longer delay.
The order directed the plaintiffs (the group of companies that filed the challenge) to file a brief by 5 June, and the government to respond to it by 9 June.
The context: The appeals ruling also came after a separate federal judge in Washington had also ruled against the tariffs, but his injunction was limited to two toy companies.
The Trump administration indicated it may seek Supreme Court intervention and said the original trade court did not interfere with ongoing trade negotiations.
