Obeids, oligarchs and immunity: The High Court’s busy November
Corrupt former Labor MP Eddie Obeid is among a colourful cast for the High Court's November sittings.
The High Court has a busy November docket, featuring the corrupt former NSW Labor MP Eddie Obeid, a Russian oligarch, and an immigration detainee’s claim for false imprisonment.
However, the sitting fortnight will kick off on Tuesday with CCDM Holdings v The Republic of India, which will test the limits of foreign state immunity.
The case involves a claim by Mauritian investors in the satellite communications startup Devas Multimedia, first lodged in 2012 after India annulled a satellite services agreement between Devas and the government-owned company Antrix.
It was finally decided in 2020, with an award of USD111 million ($170 million) to CCDM and a finding that India had breached a bilateral treaty by expropriating the investors’ interests and failing to provide “fair and equitable treatment”.
