High Court dismisses Zip’s trademark infringement appeal

The news: The High Court has dismissed Zip’s appeal against a Federal Court judgement regarding a trademark infringement claim brought by Firstmac.

The context: The decision requires Zip to stop using the “Zip” trademark in Australia for its products and services within 28 days. The decision does not impact its US business.

This follows Zip lodging an application for special leave to appeal the Federal Court’s decision to uphold a trademark infringement claim by mortgage provider Firstmac last year.

The High Court unanimously held that Zip did not affirmatively establish its honesty from the time of the first potential infringement in November 2013.
