The pop star derided the designer in emphatic terms in 2009 — extracts below — while contesting the trade mark the designer had taken out a year earlier.
The designer sued Perry in 2019, but it backfired in 2024 when the Full Federal Court decided her mark should never have been registered in 2009 and cancelled it.
However, on Wednesday the High Court sided with the designer — and with the trial judge, Justice Brigitte Markovic — finding the singer had not been able to prove that consumers connected the two brands or were actually confused, either in 2008 or 2019.
