'Never in his wildest nightmares': Adir Shiffman grilled on Sleeping Duck dispute

Adir Shiffman's cross examination in his Sleeping Duck lawsuit is focused on how much Shiffman knew about fellow minority investor - Prateek Bandopadhayay - and when.


As James Peters KC, closed out his cross examination of Adir Shiffman on Thursday, the barrister acting for online mattress startup Sleeping Duck had one final question for the Melbourne investor and entrepreneur.

He asked whether Shiffman had any final points he wanted to raise about "how unfairly you've been treated." Shiffman duly obliged, saying "never in his wildest nightmares" would he have anticipated this is how his relationship with Sleeping Duck would end "with me unable to access any of the value of my shares."

Peters told Shiffman he could have transferred his shares to a third party.

"It is unrealistic," Shiffman refuted. "No third party shareholder would buy in without a shareholder agreement" and risk hostility from the founders, he said.
