Wollemi v Wollemi trademark dispute hinges on Denholm's head start on Bishop

A focus has emerged in the trademark appeal between Robyn Denholm’s Wollemi Capital Group and Tim Bishop’s climate tech VC Wollemi Capital.

In the first Federal Court appearance of a trademark dispute between Tesla chair Robyn Denholm’s family office and former Macquarie Capital chief Tim Bishop’s climate tech VC firm, the appeal’s focus began to take shape.

Appearing before Registrar Susan O’Connor on behalf of Denholm’s family office in Sydney on Monday, Ed Heerey KC presented the basis of his client’s appeal against a 12 June IP Australia decision.

“Our case is our client made use of the trademark before my friend’s client existed at all,” Heerey told the court.

Denholm’s Wollemi Capital Group had lost its opposition to a trademark application by Bishop’s Wollemi Capital, which was linked to the words “Wollemi” and the phrase “Wollemi Capital".
